Terms

Terms of Service

These terms are the agreement between you and Vesprit. Vesprit is operated by an individual developer. "We" and "us" mean that developer. "You" means you.

By creating an account or using the app, you agree to these terms. If you do not agree, do not use Vesprit.

We have tried to write these in ordinary English. Where a section matters more than the others, we have said so rather than hoping you notice.

1. What Vesprit is

Vesprit is a study tool for Android. You paste in material you are studying, an AI model extracts question-and-answer concepts from it, and the app brings those concepts back to you for recall practice, tracking which ones are fading based on how you have answered them before.

That is the whole product. Section 3 covers what it is not, and section 3 is the most important section in this document.

2. Eligibility and your account

You must be at least 13 years old to use Vesprit. Where the law where you live sets a higher minimum age for agreeing to online services on your own, you must meet that age instead.

You need an account, which means an email address and a password. You are responsible for keeping your password secure and for what happens under your account. Give us an email address you actually control, because it is the only way we can reach you and the only way we can verify a deletion request.

One person, one account. Do not share it.

3. Vesprit is not professional advice

Read this section even if you skip the rest.

Many of the people who use Vesprit are studying medicine, nursing, or professional certifications. This section is written for you specifically.

Vesprit is a study tool. It is not a source of medical, clinical, nursing, legal, financial, tax, or any other professional advice. Nothing in the app is reviewed by a clinician, a lawyer, an accountant, or any qualified professional, because there isn't one involved.

The concepts in the app are generated by an AI model from whatever you pasted in. We do not check them. We do not verify them against any authoritative source. They can be wrong, incomplete, out of date, or subtly distorted from your original material in ways that are easy to miss precisely because they read fluently. You are responsible for checking every concept against your own authoritative sources. If a concept in Vesprit disagrees with your textbook, your guidelines, or your instructor, they are right and Vesprit is wrong.

Where a source is long, coverage may be incomplete. Large sources are processed only in part, and the resulting concept list may miss material that was in the text you pasted. Never treat a source's concept list as an exhaustive account of that source. The app flags a source it could not fully process, but you should not rely on the absence of a flag as proof of complete coverage.

Do not use Vesprit for any real-world decision. Not for patient care, not for diagnosis, dosing, or treatment, not for a clinical, legal, financial, or regulatory decision, and not for anything where being wrong has a consequence for someone. It is a tool for practising recall of material you are learning, and that is the only thing it is safe for.

We make no guarantee about exam outcomes. Vesprit will not guarantee that you pass anything. The fade score and the at-risk ranking are a prediction computed from your own answer history. A prediction is not a promise, and no part of the app is a statement about how you will perform on an exam.

4. Your material, and who owns it

You keep everything. We claim no ownership of anything you paste into Vesprit, and no ownership of the concepts extracted from it. It is yours.

You grant us only the permission we need to run the service for you: to store your material, send its text to our AI provider for concept extraction, and show it back to you. That permission ends when you delete your account. We do not use your material to train any model, and our AI provider does not use it to train theirs.

You are responsible for having the right to use what you paste in. Textbooks, lecture slides, purchased question banks, and course materials usually belong to someone. Whether you are allowed to paste them into a private study tool is between you and whoever owns them. By using Vesprit you confirm that you have the right to use the material you add, and you accept responsibility if you do not.

5. Acceptable use

Do not use Vesprit to:

  • Store or process material you have no right to use.
  • Break the law, or help anyone else break it.
  • Attack, overload, probe, or reverse engineer the service, or attempt to reach anyone else's account or data.
  • Automate, scrape, or resell access to the service.
  • Circumvent the free tier limits or the paywall.

We can suspend or close an account that does any of this. For anything that puts other users or the service itself at risk, we can do it without notice.

6. Free tier and subscription

6.1 Free tier

Vesprit is free to use with up to 3 sources. Recall practice, fade tracking, and the timeline are free and stay free. Going past 3 sources needs a subscription.

6.2 Price

The subscription price is set in the app store and shown to you there before you buy anything. We are deliberately not printing figures on this page until the store listing is live, so that this page cannot quietly disagree with the amount you are actually charged.

Prices are set in US dollars and may differ in your local currency and with local taxes, as set by the store.

6.3 The store handles the money, not us

This is the part people are most often surprised by, so it is stated plainly.

Your subscription is purchased from, charged by, and renewed by Google Play or the Apple App Store. They hold your payment method. We never see your card details, and neither does our subscription provider. We receive only the fact that you have an active subscription.

Consequently:

  • Auto-renewal. Subscriptions renew automatically until you cancel. Renewal timing, price-change notice, and the exact terms of renewal are governed by the store's terms and your store account settings, not by us.
  • Cancellation happens in the store, not in the app. Cancel in your Google Play or App Store subscription settings, and do it before the renewal date. A cancellation takes effect at the end of the period you have already paid for. We cannot cancel a subscription for you. We have no ability to, whatever we might want to do.
  • Refunds are handled by the store, under the store's refund policy. We cannot issue a refund directly. If you think you are owed one, request it from Google Play or Apple. We are happy to help you word the request, but we cannot process it.

6.4 Deleting your account does not cancel your subscription

Cancel in the store first, then delete

If you delete your Vesprit account while a subscription is active, the subscription keeps running and you keep being charged, for an app you can no longer sign in to.

Full instructions are on the deletion page.

7. Records you cannot delete individually

Once you record a recall attempt, it is permanent. You cannot edit it, you cannot delete it on its own, and we cannot either through the normal app.

This is deliberate. The fade score is only meaningful over a complete and unedited history. A score computed from records you could prune would be a score you could talk yourself into.

Individual sources and concepts also have no delete control in the app today. If you want your material removed, the route is account deletion, which removes all of it.

8. Deleting your account, and that it is permanent

To delete your account, email support@vesprit.app from the address on the account. Full instructions are at vesprit.app/delete-account. Self-service deletion in the app is being built and is not yet available.

Deletion removes everything you added, every concept extracted from it, your whole recall history, and your account itself.

It is irreversible. We keep no backups, we operate no restoration process, and there is no grace period. Once it is done, nothing can bring it back. Export or copy anything you want to keep before you ask.

9. Availability, and what we do not promise

Vesprit is provided as is and as available. We do not promise it will be uninterrupted, error free, or available at any particular time.

In particular, concept extraction depends on a third-party AI service that can be slow, rate limited, or unavailable, and can change or be withdrawn. When that happens, extraction fails. Your existing sources, concepts, and history stay where they are.

We may change, add, or remove features. If we remove something you are paying for, cancel and the store's refund policy applies.

To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10. Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect, incidental, special, or consequential losses, including lost data, lost study time, lost income, or any exam or professional outcome.
  • We are not liable for any decision you make in reliance on content in the app. Section 3 explains why.
  • Our total liability to you, for any claim, is limited to the amount you paid us in the 12 months before the claim arose, or $50 if you paid us nothing.

Some places do not allow these limits. Where that is true, they do not apply to you, and nothing here removes rights you have under consumer law that cannot be waived.

11. Ending the agreement

You can stop using Vesprit at any time, and delete your account as described in section 8. Remember to cancel your subscription in the store separately.

We can suspend or close your account if you break these terms, or if we have to in order to comply with the law. If we close your account and you have not broken these terms, we will tell you and give you a reasonable chance to get your material out first.

We may discontinue Vesprit entirely. If we do, we will give as much notice as we reasonably can so you can export what you need.

12. Changes to these terms

We may update these terms. When we do, we will change the date at the top and, if the change is material, tell you in the app before it takes effect. Continuing to use Vesprit after a change means you accept the updated terms.
